The Register of Public Sector Partners is a list of legal and natural persons entering into a legal relationship with the government with a fulfilment above the limit set by the law. The register is kept in the electronic form and all the information included in it is considered legally binding. After considering all legal limits, the enrolment into the Register of Public Sector Partners is the responsibility of all persons signing a contract, framework agreement or concession contract following public procurement regulations, healthcare providers, persons to whom receivables from the government or public sector subjects are transferred as well as of subcontractors. The main purpose of the Register of Public Sector Partners under Act No. 315/2016 on the Register of Public Sector Partners, amending and supplementing certain acts https://www.slov-lex.sk/pravne-predpisy/SK/ZZ/2016/315/20170201, is to find and verify the end user of the advantages and ensure higher transparency within business transactions with the government.
It must be pointed out that any persons that have already been enrolled into the Register of End Users of Advantages, kept by the Public Procurement Office, are automatically considered persons enrolled in the Register of Public Sector Partners. These persons, however, are required to provide verification of the identification of the end users of advantages following the new regulation by 31 July 2017. If they fail to fulfil this obligation by 31 July 2017, they will be automatically deleted from the Register of Public Sector Partners and will not be able to claim any fulfilment with the public sector.
New public sector partners are enrolled by so-called authorised persons which may be an attorney, notary, auditor, bank, branch of international bank or tax advisor based in the Slovak Republic. The transitional period for the enrolment into the Register of Public Sector Partners ends on 31 July 2017. It you fail to fulfil the registration obligation, the government may withdraw from the contract or stop fulfilling its responsibilities under the contract.
For this reason, we would like to notify all legal and natural persons that are not yet registered in the Register of Public Sector Partners and are subject to this obligation to make the enrolment by 31 July 2017. At the same time, we would like to notify the public sector partners that are already registered to provide verification of the identification of the end users of advantages by 31 July 2017 and report any eventual changes to the Register of Public Sector Partners.
Persons that were registered in the original Register of End Users of Advantages and do not fulfil the legal limit of received fulfilment any longer, are not obliged to pre-register and will be automatically deleted from the register after 31 July 2017.
