All electronic mailboxes were originally scheduled for automatic activation on 1 January 2017 and authorities were to send all official documents to companies using the electronic mailboxes as well. However, the date of mandatory activation for legal entities with registered office in Slovakia that are not registered in the Commercial Code was changed vis-a-vis mandatory activation of legal entity mailboxes; valid legislation stipulates that the electronic mailboxes will be automatically activated to receive official correspondence as of 1 May 2018. Such entities include civic associations, foundations, non-profit organisations and other similar legal entities.
In our previous newsletter, we informed you of the mandatory activation of electronic mailboxes for legal entities. The state is establishing these mailboxes on the portal https://www.slovensko.sk/en/electronic-mailbox/electronic-mailbox at no charge. The organising authority (Government Office of the Slovak Republic) automatically creates a mailbox for every legal entity registered in the Commercial Register, the Register of Associations or other official records. Authorities will then use these mailboxes to send businesses various notices, invitations, statements, decisions, and many other documents, for example, from Social Insurance, the courts, Labour Offices and other institutions and public authorities. These entities will be able to activate their electronic mailboxes before such date to receive official correspondence voluntarily using specific electronic mailbox functions.
The change in the schedule for mandatory activation of electronic mailboxes for legal entities that are not registered in the Commercial Register is based on the Act on Trust Services for Electronic Transactions in the Internal Market and on amendment of certain acts http://www.nrsr.sk/web/Default.aspx?sid=zakony/zakon&MasterID=5936 / approved the text of the law 132 approved by parliament on 20 September 2016 and which amends Act No. 305/2013 on e-Government http://www.noveaspi.sk/products/lawText/1/84901/1/2 . The Act comes into force on the date of its declaration.
